NCLAT Quashes NCLT Order Against Culver Max Entertainment, Directs Fresh Hearing in Insolvency Case

NCLAT has set aside NCLT's April 30, 2024 order dismissing Culver Max Entertainment's insolvency plea against Rechargekit Fintech. The appellate tribunal found that NCLT failed to provide opportunity to rectify application defects before dismissal, violating IBC procedural requirements. The matter has been remanded to NCLT's Cuttack bench for fresh hearing within two months.
